President Reagan chose George Bush (Bush senior) as his Vice President and it was probably Reagan's most regrettable mistake. A big mistake in wanting to win the Presidency by choosing a second runner-up against him. Bush, a Nixon colleague, ran against and greatly criticized Reagan before Reagan won the nomination for President in the Republican Party. Remember that Reagan was almost assassinated by Hinckley and Bush is close friends to the Hinckleys. The killing of Americans by terrorist in the Middle East first began during the administration of President Ronald Reagan (R-CA) and Vice President George Bush (Bush senior).
The Beirut bombings was the beginning of terrorists killing Americans. They were against America's involvement in the Middle East. Analysts say, the bombing that killed scores of U.S. Marines in Lebanon provided a game plan for the ongoing terrorist attacks against U.S. interests. The U.S. carnage was worse than any single day of the Vietnam War. The bombing left 241 Americans dead at a U.S. marine barracks in Beirut on Oct. 23, 1983. Six months earlier, zealots had driven a truck bomb into the U.S. Embassy in Beirut, killing 17 Americans and 46 others.
President Reagan's defense secretary Caspar Weinberger thinks now there was no good reason for U.S. troops to be there to help a peacekeeping force responding to Israel's invasion of Lebanon. "I urged as strongly as I could, apparently not strongly enough, that we shouldn't be there, that we should take those troops out, at the very least put them on ships offshore,'' Weinberger said. "They were sitting in the middle of a bull's eye.''
Experts say the Beirut bombings emboldened other terrorists. And afterward, terrorists:
Osama bin Laden underscored the symbolic importance of the 1983 Beirut bombings when he told ABC News in 1998 that U.S. soldiers were ``paper tigers.'' "There is no question it was a major cause of 9/11,'' said former Navy Secretary John Lehman, a member of the Sept. 11 investigative commission quoted in Knight Ridder Newspapers.
But some warn that today's situation in Iraq, with continuing attacks on U.S. troops, may foreshadow future terrorism. "Every one of these bombings in Baghdad is a flashback to the Beirut bombing,'' said John Pike, director of GlobalSecurity.org, a Washington think tank.

hate America, but rather the foreign policy of the U.S.

the Muslim heartland of Saudi Arabia after the 1990 Iraqi

Osama Bin Laden issued a fatwa in 1996 and 1998.

committed by the Americans:

The Persian Gulf War, the ensuing sanctions against Iraq and the
bombing of Iraq by the United States were cited in 1998 as
further proof of these allegations.

Israel was established for the Jewish people after the first 1948 Arab-Israeli War. Since then, wars between the State of Israel and its Arab neighbors has been ongoing with no end in sight. Then the United States of America became involved in all Israel-Arab conflicts.
After World War II, Jewish nationalism and messianic tradition led to Zionism, a movement to re-create a Jewish nation in the Land of Israel. prior to Jesus and the New Testament, permitted the enslavement
of alien immigrants and the occupants of other countries other

who enlightens"] was the Master of the Miracles because of

Talmud. He was a descendant of the Roman Emperor Nero according
to legend.
Nero was the last emperor of the Julio-Claudian dynasty in the
Roman Empire. During Nero's earlier reign, he favored his fellow
Jews over Christians. His second wife was pro-Jew and he

White House ordered false assurances on air quality, report says

NEW YORK -- In the aftermath of the Sept. 11, 2001, attack on the
World Trade Center, the White House instructed the Environmental
Protection Agency to give the public misleading information,
telling New Yorkers it was safe to breathe when reliable
information on air quality was not available.
That finding is included in a report released Friday by the
Office of the Inspector General of the EPA. It noted that some of
the agency's news releases in the weeks after the attack were
softened before being released to the public: Reassuring
information was added, while cautionary information was deleted.
"When the EPA made a September 18 announcement that the air
was 'safe' to breathe, it did not have sufficient data and
analyses to make such a blanket statement," the report says.
"Furthermore, the White House Council on Environmental
Quality influenced . . . the information that EPA communicated to
the public through its early press releases when it convinced EPA
to add reassuring statements and delete cautionary ones."
On the morning of Sept. 12, according to the report, the office
of then-EPA Administrator Christie Whitman issued a memo: "All
statements to the media should be cleared through the NSC (National
Security Council in the White House) before they are released."
There are hundreds of

World Trade Center 7 (Salomon
Brothers Building) housed the CIA, FBI, and other government
offices. There is growing evidence the government is hiding the
fact that WTC-7 was being used by federal, state, and local
government officials for a WTC attack drill, or for something
relating to terrorism, just before 9/11 attacks. It was reported
that WTC-7 contained secret documents on terrorism. WTC-7 was not

In 1993
during the Clinton administration, the first attack by (al Qaeda)
terrorists occurred in the U.S. at the New York World Trade
Center. On Friday February 26, 1993 (at approximately 12:18 p.m.)
an improvised explosive device exploded on the second level of
the World Trade Center parking basement. As a result of the
explosion, 6 persons were killed, and more than 1,000 injured.
The site of the blast became one of the largest crime scenes in
NYPD history. Agencies quickly assisting in the on scene
investigation were the FBI, NYPD, ATF, EPA, and OSHA. A fully
operational Evidence Control Center that included eight agencies
was later established. This evidence command post incorporated
secure and non-secure telephones and facsimile, photocopiers,
radio communication with the crime scene and FBI headquarters in
New York, computers and data processors, phototelesis, and a
scheduled meeting room. The explosive device had been placed in
the rear cargo portion of a one-ton Ford F350 Econoline van,
owned by the Ryder Rental Agency, Jersey City, New Jersey.
Approximately 6,800 tons of materials were displaced by the blast.
The main explosive charge consisted primarily of approximately 1,200
to 1,500 pounds of a homemade fertilizer-based explosive, urea
nitrate. The fusing system consisted of two 20-minute lengths of
a non-electric burning type fuse such as green hobby fuse. The
hobby fuse terminated in the lead azide, as the initiator. Also
incorporated in the device and placed under the main explosive
charge were three large metal cylinders (tare weight 126 pounds)
of compressed hydrogen gas.

1990s have described how suicide terrorist could use aircraft as
weapons. Yossef Bodansky is director of the Task Force on

In a well-publicized paper from 1993 "Target America",
he stated, "The training of suicide pilots started in the
Busher air base in Iran in the early 1980s with some 90 Pilatus

suicide pilots), one of the exercises included having an Islamic
Jihad detachment seize (or hijack) a transport aircraft. Then

On December 29, 1994, four
terrorists alleged to have ties to Osama bin Laden hijacked Air
France Flight 8969, a flight from Algiers to Paris, and killed
three passengers before being captured during a stop in
Marseilles. They loaded the plane with explosives and filled it
with extra fuel, with the intent of ramming it into the Eiffel
Tower.

Eight months before al-Qaeda slammed airliners into the World Trade Center, French intelligence suspected the terror network was plotting a hijacking and warned the CIA, former French intelligence officials said. Classified documents from France's main foreign intelligence agency, the DGSE, reported that al-Qaeda was plotting a hijacking. Dated Jan. 5, 2001, a five page document was entitled "Project to hijack planes by Islamist radicals." "They are preparing a plot to hijack an airplane, and they have cited several companies." The note listed potential targets: American, Delta, Continental, and United airlines, Air France and Lufthansa. The list also mentioned US Air.
The DGSE drew up nine reports between September 2000 and August 2001 about al-Qaeda threats given to US intelligence. The warnings were another example of how intelligence agents knew al-Qaeda was hard at work in the months leading up to Sept. 11.
Two CIA agents on al-Qaeda claim not to remember the warnings sent by the DGSE. Gary Berntsen directed the CIA operations from 1982 to 2005 and Michael Scheuer was responsible for the Bin Laden unit of the CIA.
The 9/11 commission did not mention that the CIA knew about the January 2001 information emanating from the French intelligence on Osama Bin Laden to organize hijackings of American planes.
The 9/11 commission said that, as the year 2001 began, the CIA started receiving "frequent but fragmentary" threat reports. Among other warnings, the intelligence community sent out a March 2001 terror threat advisory about a heightened threat of Sunni extremist attacks against U.S. facilities, personnel and other interests. George Tenet, CIA director at the time, told the commission that "the system was blinking red."
Another report from French intelligence, dated September 13, 2001, and entitled “Elements on the financial resources of Osama Bin Laden”, reiterates the suspicions against the Saudi Bin Laden Group (SBG), the family empire. It mentions a powerful banker, formerly close to the royal family, as the historical architect of the money that “transfered to the terrorist the funds coming from the countries in the Gulf.” An appendix of this report indexes the credits under the direct control of Osama Bin Laden. Also it mentioned that the "Sheik” directed funds to Sudan, Yemen, Malaysia, and Bosnia in 2001 and a hotel located within Mecca, Saudi Arabia.
Alain Chouet expressed a
real skepticism on the will of the authorities in Riyadh to
apprehend Osama Bin Laden before September 11, “They were
ignoring a Saudi national…To my knowledge, nobody put
anything in works to capture him between 1998 and 2001.” In
a report on October 2, 2001 it mentioned “the removal of
Prince Turki al-Faisal, head of Saudi intelligence was a
political ousting” just before September 11. The report
underlined “the limits of the Saudi influence in
Afghanistan…At the time of recent trips in Kandahar by
Prince Turki that had not succeeded in convincing its leaders to
extradite Osama Bin Laden.”

On April 19, 1995 (Wednesday)
around 9:02 a.m., a Ryder rental truck exploded at the Murrah
Federal Building in downtown Oklahoma City. It destroyed half of
the nine-story building and killed 168 people. A massive
investigation was undertaken by the FBI, as lead agency, with the
assistance of other agencies including the Bureau of Alcohol,
Tobacco and Firearms (ATF). It was the worst terrorist attack on
U.S. soil to that date. The truck bomb was believed to have been
approximately a 4,000 pound mixture of ammonium nitrate
fertilizer and fuel oil (ANFO). The initiator for the boosters
was either a detonator from a Primadet Delay system or sensitized
detonating cord that was a non electric detonator, burning type
fuse of either hobby fuse or a commercial safety fuse used as a
safe separation and time delay system. This conclusion, in part,
because Terry Nichols, one of the defendants in the case,
purchased ammonium nitrate and diesel oil prior to the bombing.
The Primadet systems were found at defendant Nichols' house and
an accomplice's house. Without the evidence of these purchases,
the FBI Laboratory would have been unable to conclude that ANFO
was used. No evidence of a Primadet system or sensitized
detonating cord was found at the crime scene. Based on the post-blast
scene alone it could have been dynamite or could have been other
things.

During the Clinton
administration in 1995, Philippine authorities arrested Ramzi
Yousef and Abdul Hakim Murad after a chemical fire at their
Manila apartment. Under questioning, Murad admitted connections
to bin Laden and spoke of a plot to dive-bomb a jetliner into the
CIA headquarters in Langley, VA. He also said Middle Eastern
pilots were training at U.S. flight schools in preparation for a
plot to blow up 12 passenger jets over the Pacific Ocean. The FBI
was alerted at the time and interviewed flight school attendees,
but it did not develop evidence that any of the Middle Easterners
were plotting terrorism.

In 1995 during the Clinton administration, the FBI was alerted that Middle Eastern pilots were training at U.S. flight schools and at least one had proposed dive-bombing a jetliner into a federal building. The government had very general information about an idea, not a complete plan, for flying a plane into the CIA headquarters near Washington. FBI agents investigated the flying schools in 1995 and did nothing more.
The 1996 Gore Commission
recommended a long list of steps that it said were urgently
needed to provide stronger airline security against terrorism.
The airline industry and aviation lobbies said it would cost them
too much so they lobbied to weaken the safety recommendations.
Most of the proposals were eliminated by industry lobbying and
others were slowed down in bureaucracy. Officials now say that
all the commission's recommendations might have prevented the
Sept. 11 terror attacks.

Mysterious crash of TWA
Flight 800 on July 17, 1996
On July 17, 1996 (Wednesday), about 2031 Eastern Daylight Time,
Trans World Airlines, Inc. (TWA) flight 800, a Boeing 747-131, N93119,
crashed in the Atlantic Ocean near East Moriches, New York. TWA
flight 800 was operating as a scheduled international passenger
flight from John F. Kennedy International Airport (JFK), New York,
New York, to Charles DeGaulle International Airport, Paris,
France. The flight departed JFK about 2019, with 2 pilots, 2
flight engineers, 14 flight attendants, and 212 passengers on
board. All 230 people on board were killed, and the airplane was
destroyed. The crime scene was underwater,
under sea water. And prior to any knowledge
of explosives on-board, the FBI laboratory found, and had
confirmed by Defense Evaluation Research Administration (DERA),
explosive residue consistent with C-4 on a piece of carpet. This
was found prior to any knowledge by the FAA or NTSB that a dog
training program had occurred on that aircraft in the exact
location that the dog handlers had said they had placed the
explosive, C-4. A short circuit outside of the center wing fuel
tank that was transferred into the tank through electrical wiring
or was it a terrorist shoe bomber with C-4 explosives seating
above the wing, or terrorist stowaway hiding in the wheel well of
the landing gear with C-4, or U.S. military accident caused by
strong RF energy aimed at the jet overloading its wiring, and/or

President Clinton's administration on December 14, 1998 [at least this news made it to the general public sooner possibly thwarting the enemies current attack plans] reported that Osama bin Laden may be planning a strike on Washington or New York after a US missile strike on his Afghan headquarters. US Attorney General Janet Reno organized an exercise at FBI headquarters in Washington on October 14, 1998 to plan for a possible terror attack by bin Laden. A bin Laden ring that had been planning an attack on the US embassy in Baku, Azerbaijan was broken up three months ago. US agencies were questioning whether they could have prevented the August 7, 1998 twin bombings of US embassies in Kenya and Tanzania that killed 224 people including 12 Americans. In 1996, the CIA was planning to snatch bin Laden from a foreign country and bring him to trial in the United States, but he avoided travel to those countries. Intelligence officials discovered in 1993 that bin Laden was shopping for nuclear weapons but bin Laden agents scouring former Soviet republics for enriched uranium and weapons components were offered unusable low-grade reactor fuel or radioactive garbage.
A FBI memo titled "WEAPONS
OF MASS DESTRUCTION" dated May 18, 1998 notes the FBI's
chief pilot in Oklahoma City had "advised that he has
observed large numbers of Middle Eastern males receiving flight
training at Oklahoma airports in recent months." The pilot,
a FBI special agent, "states this is a recent phenomenon and
may be related to planned terrorist activity." The pilot
"speculates that light planes would be an ideal means of
spreading chemicals or biological agents," according to the
memo.

September 1999 a US government
report said, "Suicide bomber(s) belonging to al-Qaida's
Martyrdom Battalion could crash-land an aircraft packed with high
explosives (C-4 and semtex) into the Pentagon, the headquarters
of the Central Intelligence Agency (CIA), or the White House."
Following the August 1998 cruise missile attack, at least one
Islamic religious leader called for Clinton's assassination, and
another stated that "the time is not far off" for when
the White House will be destroyed by a nuclear bomb. A horrendous
scenario consonant with al-Qaida's mindset would be its use of a
nuclear suitcase bomb against any number of targets in the nation's
capital. Bin Laden allegedly has already purchased a number of
nuclear suitcase bombs from the Chechen Mafia.

as Bush took office he removed the submarines, the Predator and

Bush and his
Administration had many other priorities and did not seriously
address the
terrorists threat
until after 9/11, and Bush and Cheney did not attend meetings
about the
threats. Bush took a one month vacation at his ranch while the
Director of
the CIA warned the Administration time and again about possible
terrorists
attacks. In June of 2001 the Predator was equipped with a
hellfire missile
and tested on a replica of Osama's house in Nevada. But Bush did
not order
this specially developed weapon to Afghanistan until after the 9/11
attacks.
From what I have learned by reading the articles and listening to
the
reporter on NPR on 1/23/02 Bush and his team screwed up big time.
And this leaves out FBI investigator, John O'
Neill, that resigned two weeks before 9/11 because his
investigation into
Osama was thwarted by the Bush administration.

America's failure during the Clinton administration to retaliate massively after past al-Qaeda attacks against U.S. military barracks, battleships and embassies tempted bin Laden to go after ever more outrageous targets—and finally the World Trade Center.
Another clue to Sept. 11 came in 2000 when the CIA was watching two of the Sept. 11 hijackers at an al-Qaida meeting more than a year before the attacks, but failed to notify the FBI or the Immigration and Naturalization Service of their activities. A radical Indonesian cleric, Riduan Isamuddin who was living in Malaysia, was suspected of having deep ties to al-Qaida and other terrorist organizations. The cleric, who goes by the name Hambali, was under surveillance in January 2000 when he met with two future Sept. 11 hijackers — Saudi nationals Khalid Almihdhar and Nawaf Alhazmi — in Kuala Lumpur, Malaysian authorities have said. The investigation into Hambali also linked the cleric to another alleged Sept. 11 player, Zacarias Moussaoui, who was arrested on a visa violation in August 2001 after raising suspicions during flight training in Minnesota. The FBI says it was not warned about Almihdhar until just weeks before the Sept. 11 attacks, but CIA officials said they notified the FBI in January 2000 that he attended a meeting of suspected terrorists in Malaysia.
Sept. 11 Lapses Echoed

The CIA first learned of two of the eventual Sept. 11 hijackers
at a meeting in Malaysia in early 2000 but didn't alert domestic
authorities to watch for them until three weeks before the
attacks, U.S. officials acknowledged June 3, 2002. Malaysian
authorities monitored the meeting, which was attended by Khalid
Almihdhar and Nawaf Alhazmi, two of the hijackers who flew
American Airlines Flight 77 into the Pentagon, and passed on the
information to the CIA. At the time, the significance and subject
of the 2000 meeting were not clear, said a U.S. intelligence
official, speaking on the condition of anonymity. But CIA
informed FBI headquarters, as well as FBI agents in the CIA's
counterterrorism center, that the meeting took place. But the
names of Almihdhar and Alhazmi didn't make it onto a watch list
— used by the Immigration and Naturalization Service and
State Department to deny entry into the United States —
until Aug. 23, when the two were already in the country, the
official said. It's unclear when their identities were confirmed,
and whether the FBI learned their names from the CIA. Sen.
Richard Shelby, R-Ala., complained of "massive failures of
intelligence at the CIA.'' He said CIA Director George Tenet
"is in denial. But I believe he is totally wrong.'' Also at
the January 2000 meeting in Malaysia was Tawfiq Attash Khallad,
lately identified as one of the U.S. top 25 targets in the war on
al-Qaida, the intelligence official said. The current status of
Khallad is unclear. The meeting gained much greater significance
at some point after the bombing of the USS Cole in Yemen on Oct.
12, 2000. Investigators learned that Khallad was one of the
masterminds of the plot, and his known associates —
including Almihdhar and Alhazmi — suddenly took on new
importance. But it's unclear if this new information was
transferred to other authorities, such as the FBI, State
Department and INS, until months later, the official said. These
agencies remained unaware of the new significance given to
Almihdhar and Alhazmi by the CIA. On Aug. 23, 2001, the CIA
worried that a large al-Qaida operation was in the offing, put
out an alert on Almihdhar and Alhazmi, adding them to a watch
list. By that time, they already had entered the United States.
At least one other al-Qaida operative now thought to be a
potential Sept. 11 hijacker — Ramzi Binalshibh — was
denied access to the United States before the attacks. He was not
arrested or interrogated, and remains at large.
Suicide bombings are
nothing new for people such as Hamas and Islamic Jihad. Israel in
the past has shot down suspected terrorist suicide aircraft. May
26, 2001 -- Israel shot down a light plane it believed was on a
suicide mission from Lebanon.

Washington received a
threat on President Bush's life at the G8 summit in Genoa, Italy.
Osama bin Laden has threatened to assassinate U.S. President
George W. Bush at a G8 meeting in Italy, the head of Russia's
Federal Bodyguard Service has said. Italy closed Genoa's airspace
and mounted a short-range, anti-aircraft battery at the airport
during the July 2001 summit. Islamic extremists were said to be
planning to hit Bush in a suicide plane attack. There is amazing

German Federal Intelligence Service (BND) warned the CIA and Israel in June 2001 that Middle Eastern terrorists were "planning to hijack commercial aircraft to use as weapons to attack important symbols of American and Israeli culture." The BND warnings were also passed to the United Kingdom. German police, monitoring the phone calls of a jailed Iranian man, learned the man was telephoning U.S. intelligence agencies last summer to warn of an imminent attack on the World Trade Center in the week of Sept. 9. German officials confirmed the calls to the U.S. government for the story but refused to discuss additional details. No known denial by the BND of the accuracy of this story exists.
According to a Russian news story, the Russian intelligence warned the U.S. last summer 2001 that as many as 25 suicide pilots were training for suicide missions involving the crashing of airliners into important targets. In an TV interview Russian President Putin stated he had ordered Russian intelligence to warn the U.S. government "in the strongest possible terms" of imminent assaults on airports and government buildings before the attacks on Sept. 11. No credible information has emerged from any source indicating that Putin omitted the above information when issuing the warning.

already on high alert, the U.S. State Department is expected to
issue a travel advisory shortly warning Americans traveling
overseas to be on their guard. Videotapes allegedly show Osama
bin Laden threatening to attack U.S. interests in the region.
Indictments against 13 Saudi nationals and one Lebanese, charging
them with killing 19 US servicemen at a military base in Saudi
Arabia in 1996 appears to be the catalyst. With the announcement
of the indictments, U.S. Attorney General Ashcroft noted how
terrorists are targeting the United States. "Americans are a
high-priority target for terrorists," he said. In recent
years, U.S. citizens have found themselves the target of several
attacks by the terror network of Osama bin Laden. One such attack
involved a plot to destroy 12 U.S. airliners in Asia. A jury
found Ramzi Ahmed Yousef the alleged mastermind of the scheme,
and two other defendants, guilty on all counts. Yousef is also
the alleged mastermind of the 1993 bombing of the World Trade
Center and is also linked to schemes to assassinate President
Clinton and the Pope. Just prior to the attack of the Saudi
military base, officials uncovered the plot to blow up 12 U.S.
airliners on January 6, 1995 when a fire broke out in a Manila
apartment. During the trial a Secret Service agent testified that
Yousef boasted during his extradition flight to New York that he
would have blown up several jumbo jets within a few weeks if his
plan had not been discovered. The government said the defendants
even devised a name for their airline terror plot named, "Project
Bojinka." Tapes played in court showed the defendants
talking about how much they enjoyed killing Americans. In a test
run, a bomb was placed on a Philippine Air Lines 747 flight to
Tokyo. It exploded, killing a Japanese passenger. The Arabic
satellite television channel MBC has reported, "the next two
weeks will witness a big surprise." A reporter of MBC said,
"A severe blow is expected against U.S. and Israeli
interests worldwide." MBC said the reporter met with Osama
bin Laden two days ago in Afghanistan. "There is a major
state of mobilization among the Osama bin Laden forces. It seems
that there is a race of who will strike first. Will it be the
United States or Osama bin Laden?" the correspondent said.
June 25 is the fifth anniversary of the 1996 bombing of the
Khobar Towers bombing which killed 19 U.S. servicemen. Bob
Monetti, President of the Victims of Pan Am Flight 103 said,
"I hope the airlines are watching this situation closely."
Mr. Monetti, who lost his son Rick on Pan Am 103 is also a
special advisor to the FAA on security related matters. Monetti
is hopeful about the progress that has been made since the
bombing of Pan Am 103. However, Monetti expressed serious concern
about the abilities of the airlines to stop a terrorist
organization from carrying out their plans as promised. Monetti
noted that Osama bin Laden has had several terrorist targets over
the years and not all of them have been military. "The
airlines are at risk -- They need to take all appropriate
measures and counter-measures to ensure the safety of their
passengers," Monetti said.

Two months [July 2001] before the September 11 suicide hijackings, the FBI sent intelligence to its terrorism experts in Washington and New York for analysis. FBI counterterrorism agents in Phoenix were investigation several Arab men seeking airport operations, security information and pilot training and recommended that the FBI begin alerting local agents when Middle Easterners sought visas for training at local aeronautical schools. The memo said FBI "Phoenix believes that the FBI should accumulate a listing of civil aviation universities/colleges around the country." "FBIHQ should discuss this matter with other elements of the U.S. intelligence community and task the community for any information that supports Phoenix's suspicions." The classified memorandum also cited Osama bin Laden by name and suggested that his followers could use the schools to train for terror operations. FBI critics on Capitol Hill responded. "This is one of several incidents that raise more questions about what the FBI knew of terrorist plans before Sept. 11, and about how the FBI handled the information," said Sen. Charles E. Grassley (R-IA). Senate Judiciary Committee Chairman Patrick J. Leahy (D-VT) said the revelations "only underscore the need for a thorough and constructive congressional investigation of the facts." Filipino authorities alerted the FBI as early as 1995 that several Middle Eastern pilots were training at American flight schools and at least one had proposed hijacking a commercial jet and crashing it into federal buildings. One month before the suicide hijackings, FBI agents in Minnesota arrested a French citizen of Moroccan descent, Zacarias Moussaoui, after a flight school instructor became suspicious of his desire to learn to fly a commercial jet.
In July
2001, U.S. Attorney General John Ashcroft was urged by his top
security experts not to fly aboard commercial flights. Neither
the FBI nor the Justice Department would identify what the threat
was, when it was detected, or who made it. The FBI had no further
comment. Janet Reno, Ashcroft's predecessor as attorney general
routinely flew aboard commercial flights. The secretaries of
State and Defense traditionally travel with extra security on
military planes.

This is not a confirmed report. A CIA "immediate" secret message was addressed to the FBI, State Department's Intelligence and Research office, the Customs Department and the INS on Aug. 27, 2001 over a classified government computer network. It warned that two "Bin Laden related individuals" had entered the United States and that two other suspected terrorists should be barred from entering. The FBI failed to find two men whom later became suspected hijackers. The government uses four alert levels - routine, priority, immediate (means emergency) and flash (reserved only for serious events, such as war).
A Minneapolis flight instructor phoned the FBI last August to alert the agency that a terrorist might be taking lessons to fly a jumbo jet. It appears that the FBI and the FAA could have responded more vigorously, the school was clearly more alert than federal officials were. Moussaoui, the student, was arrested Aug. 16 and held on an immigration violation. The FBI checked Moussaoui's name with foreign intelligence agencies. The French intelligence service warned that he might have terrorist connections. FBI agents in Minneapolis finally obtained a warrant after the Sept. 11 attacks.
The 20th hijacker had been a suspect for years but he was ignored by intelligence agencies. Zacarias Moussaoui was arrested in Minnesota on an immigration violation nearly three weeks before the attacks on America after raising suspicions at a local flying school. The school reported him to the FBI. He was detained in August and was never properly investigated by the FBI despite repeated warnings from French intelligence that he was a member of al-Qaida.
A French secret service report communicated to the CIA on Sept. 7, 2001 warned of possible attacks, and that the order to act would come from Afghanistan.
U.S. intelligence overheard al-Qaeda operatives discussing a major pending terrorist attack in the weeks before Sept. 11 and had agents inside the terror group, according to U.S. officials. Two U.S. intelligence officials, paraphrasing highly classified intercepts, say they include such remarks as, ''Good things are coming,'' ''Watch the news'' and ''Tomorrow will be a great day for us.''
Newsweek journalists Evan Thomas and Mark Hosenball reported on September 24, 2001. 'On Sept. 10, NEWSWEEK has learned, a group of top Pentagon officials suddenly canceled travel plans for the next morning, apparently because of security concerns.' Newsweek removed the story from the Internet.
Lynn Wingate, who is on administrative leave from the FBI, and former FBI agent Jeffrey Royer are being charged in a stock trading racketeering conspiracy. Royer, who left the FBI in December 2001, faces charges that he possessed confidential FBI material both while he was an agent and after he left and passed it on to Amr I. Elgindy, a self-styled Wall Street short seller of stocks. The indictment also charges that when Royer left the FBI, he continued to access confidential FBI files through Wingate. Elgindy's attempt to liquidate the trust accounts of his children on Sept. 10 might "perhaps" mean he had "pre-knowledge of the Sept. 11 attacks, and rather than report it he was attempting to profit from that information." Defense attorney Jeanne G. Knight scoffed at that suggestion and said it was an attempt by the prosecution to smear Elgindy, an U.S. citizen and native of Egypt, with "terrorist innuendoes."
Italian police intercepted phone conversations between Islamic militants that indicate Italy may have been used as a base for preparing the Sept. 11 attacks. In conversations conducted from August 2000 to February 2001, an Egyptian imam known as Es Sayed Abdelkader discusses a training camp in Italy for young militants and a possible attack on the United States. He fled from Italy two months before the attacks is considered by the United States to be the organizer of al-Qaida's cell in Milan. On Aug. 12, 2000, Es Sayed allegedly spoke to a Yemeni known as Abdulsalam Ali Abdulrahman, or Al Hilal, about a training camp for militants in Italy and an attack on the United States that appears to foreshadow Sept. 11. "Are there many young people at your training camp?" Al Hilal asked. "A few -- about 80," Es Sayed replied, before the two go on to discuss differences in airport security in Rome and the Yemen capital Sanaa. Later Al Hilal told Es Sayed: "You know that we are in a country full of enemies of God, but we are always mujahideen fighters ... We can conquer any power using sparks and airplanes. They can't stop us even with their greater weaponry. We just have to hit them and keep our heads high." The two then allegedly discussed the dangers of cloud cover and rain for an aerial attack and Al Hilal finished by saying, "There will be Jihad -- all the newspapers of the world will write about it." In a transcript of a January 2001 conversation there is discussion of false documents between the imam and a Tunisian who was later arrested in Milan by Italy's anti-terrorist police. The Tunisian asks: "Are they needed for our brothers who will go in the United States?" "Don't ever repeat these words!" the imam warns. The intercepted conversations were reportedly made from bugs in place where the men were located in addition to phone taps.

While the World Trade Center ashes were still glowing, Bush and his aides told the public that they had no reason to suspect this type of horrific attack was about to occur. Yet, as the final report of the joint inquiry of the House and Senate intelligence committees notes, for years the intelligence community had collected information reporting that terrorist outfits, including al Qaeda, were interested in mounting 9/11-like attacks — that is, hijacking airliners and crashing them into high-profile targets in the United States. U.S. intelligence services, the Pentagon, and the Federal Aviation Administration during the Clinton and Bush II years apparently did not take action in response to these reports. That was a systemic failure. Bush has never addressed it publicly, but if pressed he could blame the bureaucrats at the CIA, the Defense Department and the FAA for ignoring clear-and-present hints.
Bush is more vulnerable regarding warnings about al Qaeda that were sent to the White House during his first eight months in office. In May 2002, media reports revealed that the August 6, 2001, Presidents Daily Brief (PDB) had included material regarding Osama bin Ladens interest in hijacking airliners. That caused a brief controversy for Bush. And in September 2002, the House and Senate intelligence committees disclosed that an early July 2001 intelligence warning had noted, we believe that [bin Laden] will launch a significant terrorist attack against the U.S. and/or Israeli interests in coming weeks. The attack will be spectacular and designed to inflict mass casualties against U.S. facilities or interests. Attack preparations have been made. Attack will occur with little or no warning.
The questions are obvious. Was this dramatic July warning shared with Bush and his top advisers? If so, what did they do? And what did the August 6 PDB presented to Bush actually say? How did Bush react to it?
Such queries are not necessarily difficult to resolve. To fulfill its mission, the 9/11 commission ought to provide the answers. But the Bush administration, to date, has acted to stop such answers from reaching the public. When the August 6, 2001, briefing hit the headlines 18 months ago, National Security Adviser Condoleezza Rice pooh-poohed it and told reporters that the PDB had contained merely a general warning about al Qaeda. And when the House and Senate intelligence committees revealed the existence of the July 2001 warning, the Bush administration refused to allow the committees to say whether this warning had been passed to Bush and his national security advisers. It would only let the committee's report that the warning had been furnished to unnamed senior government officials.
With these actions, the White House blocked the public from learning what Bush had been told about the al Qaeda threat in the weeks before 9/11, and it hid information that could cause Americans to wonder if Bush might have not reacted to the warnings with sufficient vigor. But the preliminary evidence is that the White House has been protecting itself. According to the House and Senate intelligence committees final report on 9/11, the committees were told by an intelligence community representative that an August 2001 intelligence report included information that bin Laden wanted to conduct attacks in the United States, that al Qaeda members had been residing and traveling to the United States for years and had apparently maintained a support structure here, that bin Laden was interested in hijacking airliners (to trade for prisoners), that the FBI had discerned patterns of activity consistent with preparations for hijackings, and that bin Laden supporters were planning attacks in the United States with explosives.
That sure is different than a general warning about al Qaeda. Did this information appear in Bush's August 6, 2001, PDB? The committees are not in a position to say, but their staff has told reporters they strongly believe some — if not all — of this material was included in the PDB. That suggests that Rice misled the public about this briefing and that Bush had been presented with more than a routine warning about al Qaeda. And one Democratic senator on the committee told reporters (including me) that the July warning — the one noting a spectacular attack loomed — had indeed gone to senior White House officials and the president.
The current battle over Bush's PDBs is important. They can show what Bush knew before 9/11 about al Qaeda's designs. They can provide a foundation for evaluating — finally — whether he and the federal government acted responsibly and reasonably in the weeks and months before the attacks. Which is one reason why anyone with an inquiring mind should be suspicious of a deal that does not provide the commission unfettered access to these reports and that grants the White House the possible means to protect a serious but little-noticed cover-up.
Dec. 17, 2003 -- For the first time, the chairman of the independent commission investigating the Sept. 11 attacks is saying publicly that 9/11 could have and should have been prevented. "As you read the report, you're going to have a pretty clear idea what wasn't done and what should have been done," Thomas Kean said. "This was not something that had to happen." "There are people that, if I was doing the job, would certainly not be in the position they were in at that time because they failed. They simply failed," Kean said. Kean admits the commission also has more questions than answers. Asked whether we should at least know if people sitting in the decision-making spots on that critical day are still in those positions, Kean said, "Yes, the answer is yes." But he resisted pinning blame on either of the last two presidential teams.

The Sept. 11 panel,
formally known as the National Commission on Terrorist Attacks
Upon the United States, was established by Congress to study the
nation's preparedness before the attacks and its response
afterward, and to recommend ways to guard against similar
disasters.
Commission members have complained that their work repeatedly has
been delayed because of disputes with the administration over
access to documents and witnesses. Last month, the panel asked
Congress to give it two additional months to finish its work,
with a July 26, 2004 deadline. After opposing an extension,
President Bush last week reversed course and said he supported it.
The dispute over documents also comes amid growing complaints of
alleged politicization on the commission. A July deadline would
mean the report would be released one month before the Republican
National Convention in New York, the site of the World Trade
Center collapse.
Family members of the Sept. 11 victims, who are seeking a January
2005 deadline to limit the influence of election-year politics,
criticized the agreement to release edited summaries.
"It sends a dangerous signal to all future presidents if 3,000
people die on your watch, you can still stonewall, prevent a full
investigation and escape any accountability or responsibility,"
said Kristen Breitweiser of New Jersey, a member of the Sept. 11
commission's Family Steering Committee. Her husband Ronald died
in the World Trade Center.
The commission previously has issued three subpoenas to force
disclosure of documents, and it was under a subpoena threat that
the White House last fall agreed to access to the daily briefings.
The panel also has subpoenaed the Defense Department, the Federal
Aviation Administration and New York City.

Report Shows FBI Misses Sept. 11 Chances
A sobering inside look at pre-Sept. 11 intelligence operations by
the Justice Department's inspector general chronicles showed in
some instances in hour-to-hour detail of how the FBI missed at
least five opportunities to uncover vital information that might
have led agents to the hijackers. "The way the FBI handled
these matters was a significant failure that hindered the FBI's
chances of being able to detect and prevent the Sept. 11 attacks,"
Inspector General Glenn Fine said in a newly released report. An
FBI agent suggested to the chain of command two months before the
attacks that there was a coordinated effort by Osama bin Laden to
send students to the United States to study ways to take down U.S.
aircraft. Failure to fully heed the agent's theory was indicative
of an agency that failed to accord strategic analysis the
attention it deserved, the report said. Even when the bureau had
hard information shortly before the attacks about the presence in
the United States of eventual hijackers Nawaf al Hazmi and Khalid
al Mihdhar, "the FBI's investigation then was conducted
without much urgency or priority," the report concluded.
According to the report, CIA employees and four FBI agents
assigned to the CIA's bin Laden unit on Jan. 5, 2000, accessed
incoming cables containing a substantial amount of information
about Mihdhar, including that he was traveling and that he had a
U.S. visa. Ten days later, Mihdhar and Hazmi were in Los Angeles.
All of the CIA and FBI personnel who were involved in the matter
now say they remember nothing about the document that wasn't sent.
The document is called a Central Intelligence Report, or CIR.
"When we interviewed all of the individuals involved with
the CIR, they asserted that they recalled nothing about it,"
the report stated. Mihdhar came under CIA scrutiny because the
National Security Agency had picked up communications that al-Qaida
operatives were planning travel to Kuala Lumpur, Malaysia, and
Mihdhar showed up at the meetings. Once in the United States,
Mihdhar and Hazmi lived openly in San Diego and "should have
drawn some scrutiny from the FBI," the report said.

Command spearheaded an effort called Able Danger that was
intended to map out al Qaeda. According to individuals that were
part of the project, Able Danger identified Mohammed Atta as a
terrorist threat before 9/11. The 9-11 Commission staff claim
that it was never given access to any information on Able Danger.
But a U.S. Congressman claims the 9-11 Commission staff received
not one but two briefings on Able Danger from former team members,
yet did not pursue the matter. Questions remain to be answered.

Paul O'Neill, President Bush's Treasury secretary in the first two years of his presidency, says the Bush administration was planning to invade Iraq long before the Sept. 11 attacks and used questionable intelligence to justify the war.
In wide-ranging interviews with the CBS program 60 Minutes and Time magazine, O'Neill said Bush and a number of top advisers began planning to get rid of Saddam Hussein soon after the 2000 election. As early as January 2001, they began looking for ways to justify an invasion, O'Neill said.
"From the very beginning, there was a conviction that Saddam Hussein is a bad person and that he needed to go," O'Neill told 60 Minutes. "From the very first instance, it was about Iraq. It was about what we can do to change this regime."
In the interviews, O'Neill was critical of Bush's leadership skills. He said Bush is too secretive and has saddled the economy with crippling long-term debt.
Bush fired O'Neill in December 2002 after clashing with the Treasury secretary over economic issues, including Bush's $1.7 trillion in tax cuts. O'Neill is the principal source for a new book about the Bush administration, The Price of Loyalty: George W. Bush, the White House and the Education of Paul O'Neill by former Wall Street Journal reporter Ron Suskind.
In the book, Suskind used materials provided by O'Neill to show that Bush administration officials targeted Saddam immediately after the election. Interviewed in the Jan. 19 (2004) edition of Time, O'Neill said the White House overstated the threat posed by Iraq.
"In the 23 months I was there, I never saw anything that I would characterize as evidence of weapons of mass destruction. ... I never saw anything in the intelligence that I would characterize as real evidence."
Suskind, also interviewed on 60 Minutes, said the Bush administration had already begun planning for an invasion of Iraq in January 2001 - eight months before the Sept. 11 terrorist attacks on New York City and Washington. The planning, Suskind said, involved discussions of war crimes tribunals, peacekeeping troops and questions about how to divide Iraq's oil wealth.
Democratic presidential candidate John Kerry said O'Neill's comments show that the administration deceived the public about its reasons for going to war in Iraq. "It would mean they were dead-set on going to war alone since almost the day they took office and deliberately lied to the American people, Congress and the world," Kerry said.
In Suskind's book, O'Neill described the president leading Cabinet meetings "like a blind man in a room full of deaf people."
The Bush administration on Jan. 12 (2004) called for an investigation focused on Paul O'Neill after apparently classified documents were aired in a television interview in which the former US Treasury secretary lambasted the leadership of George W. Bush.
The Treasury asked the Inspector-General's office to undertake an investigation into how government documents branded "secret" came to be screened on CBS television as part of a 60 Minutes interview with Mr. O'Neill.
Mr. O'Neill also supplied a file of thousands of pages of documents - including a Pentagon memo outlining foreign commercial interests in Iraqi oilfields - to Mr. Suskind to help him write the book.
Treasury officials said that former government officers were allowed to take some personal documents with them when they left office, such as personal correspondence and speeches, but classified material should not be in his possession.
The Treasury said it requested the investigation following the screening of a document branded "secret" as part of the interview with Mr. O'Neill. Another administration official said it was understood that the Inspector General's office had already been looking into the use of apparently classified documents in the book.
But the launch of the investigation will reinforce the perceptions of the Bush White House as a vindictive operation when it feels its trust is betrayed.
Bush administration officials were reported to have leaked the identity of Valerie Plame, a CIA agent, after her husband, Joseph Wilson, a former ambassador, criticized Mr. Bush for exaggerating the Iraq threat by releasing false information about Baghdad's efforts to obtain nuclear material from Niger.

Interviewed on the NBC "Today" show, O'Neill said after resigning in December 2002, he asked the Treasury Department's chief legal counsel to allow him "to have the documents that are OK for me to have."
The legal counsel's office "sent me a couple CDs, which I never opened," O'Neill said. He said he then gave them to Ron Suskind, the book's author.
He also pointed out what "60 Minutes" showed was a cover sheet from the document, and not any secret material itself.
O'Neill, who was fired by Bush because he opposed another round of tax cuts, is quoted in the book as saying he was surprised by how focused the president was on removing Saddam Hussein from power in Iraq from the start of his administration.
Trust O'Neill, Not His Critics
The U.S. Department of Justice refused to come clean about what it did to Florida resident Mohamed Kamel Bellahouel.
Bellahouel's case was revealed by mistake when it was listed on an appeals court calendar last March. Subsequent court papers show the 11th U.S. Circuit Court of Appeals in Atlanta heard arguments behind closed doors and rejected his habeas petition in a sealed decision in an unusually short 27 days.
Bellahouel came under FBI scrutiny because hijackers Mohamed Atta and Marwan al Shehhi dined where he worked as a waiter in South Florida in the weeks before the 2001 Sept. 11 attacks.
On Jan. 5 (2004), at the direction of the U.S. Supreme Court, Solicitor General Theodore B. Olson responded to the Algerian native's appeal. Bellahouel has asked the high court to review whether the government or the lower courts acted improperly by secretly imprisoning him for five months without criminal charges and keeping his habeas corpus case completely sealed and off the public court dockets.
But Olson's response -- like everything else the government and the federal courts have done in the case since it started two years ago in U.S. District Court in Miami -- was filed under seal. "This matter pertains to information that is required to be kept under seal," Olson wrote in a one-paragraph statement filed with the government's sealed response.
That new layer of government secrecy was applied just as Bellahouel's case, first disclosed by the Miami Daily Business Review last March, prompted a legal response from a broad range of national media and legal groups. A coalition of 23 organizations, including The New York Times and the Daily Business Review's parent company, American Lawyer Media, filed papers with the high court seeking to intervene as parties in the case in order to gain access to all unclassified information.
"A free and open society cannot tolerate hiding federal court proceedings from public view," said Lucy A. Dalglish, executive director of the Arlington, Va.-based Reporters Committee for Freedom of the Press. "By participating in this case, the media aim to ensure that the proper balance is drawn between secrecy in the name of national security and the public's right to know."
The Reporters Committee assembled the coalition, which is represented by Thomas C. Goldstein of Washington, D.C.'s Goldstein & Howe. Coalition members include The Washington Post, Gannett Co., Knight Ridder, the Hearst Corp., ABC, CNN, the Society of Professional Journalists and the American Immigration Lawyers Association.
Bellahouel was one of about 1,200 Arab men who were detained in the immediate aftermath of the Sept. 11 terrorist attacks. The Deerfield Beach, Fla., resident came to the attention of FBI agents, who found that two Sept. 11 hijackers, Mohammed Atta and Marwan al-Shehhi, were customers at a Delray Beach, Fla., restaurant where Bellahouel worked.
Bellahouel, who is married to a U.S.-born woman, was held at the Krome Detention Center in southern Miami-Dade County from October 2001 until March 2002. Authorities apparently concluded he was not a threat, and he was allowed to post a $10,000 bond during his appeal of the only charge against him -- overstaying his student visa. That immigration case is pending.
While Bellahouel was in custody, the Federal Public Defender's Office in Miami filed a civil case on his behalf seeking a writ of habeas corpus. That case -- which proceeded in total secrecy until last March, when the Daily Business Review first reported on it -- has now reached the U.S. Supreme Court in largely secret form. The style of the case, 03-6747, is M.K.B. v. Warden.
In Solicitor General Olson's terse public reply to Bellahouel's petition for review, he chose to maintain the heavy blanket of secrecy that has characterized the case since its inception. Olson's approach differs from the one taken by Paul M. Rashkind, the appeals chief of the Federal Public Defender's office in Miami.
Over the summer, Rashkind filed a redacted appeals petition at the Supreme Court making some case information public while still complying with gag orders issued by U.S. District Judge Paul C. Huck of the Southern District of Florida and upheld by the 11th U.S. Circuit Court of Appeals.
Bellahouel's petition attacked the lower court sealing orders, calling them "improper." The petition noted "habeas corpus proceedings are historically, and by court rule, open to the public."
The petition said that the district court and the 11th Circuit decided on their own to seal the case, because neither the government nor Bellahouel requested it. "That decision was apparently made ... without input from the parties and without the articulated judicial findings required by the court's jurisprudence," Rashkind wrote.
Rashkind argued that courts aren't supposed to close access to such cases unless a "compelling government interest" is at stake. And judges who deny access must explain themselves in an order.
Rashkind argued that the failure to issue an order justifying the sealing was legally unsupportable. "The district court's failure to give notice, hold a hearing, and to make articulated findings is an abuse of discretion and reversible error. The same is true of the court of appeals' secrecy," the petition says.
The justices have not decided whether to accept the case.
'SHOCKING' DECISION
Gregg Leslie, legal defense director for the Arlington, Va.-based Reporters Committee for Freedom of the Press, called the government's decision to respond under seal "shocking" and unnecessary.
"If for nothing but public relations reasons, I would have thought they'd have made the effort to come up with as much of a public document as they could have to show they would be as open as possible," Leslie said.
In early November, the Reporters Committee filed a friend-of-the-court brief that urged the Supreme Court to accept Bellahouel's case for review in order to decide whether extreme secrecy -- including a sealed docket -- violated the First Amendment.
Later, following consultations with First Amendment lawyers around the country, the group decided to take a stronger stance. It recruited other media and legal organizations to mount a rare attempt to intervene in the case. Such intervenor status would allow greater access to information about the case.
The reporters group, on behalf of 23 news media and immigration organizations, urged the court to open the records of Bellahouel. In the Supreme Court's public records, he is identified only as M.K.B.
The other coalition members are the American Society of Newspaper Editors, the Radio-Television News Directors Association, the American Booksellers Foundation for Free Expression, the Asian American Legal Defense and Education Fund, the Association of Alternative Newsweeklies, Military Reporters and Editors Inc., the National Federation of Press Women, the National Newspaper Association, the National Press Club, the Newspaper Association of America, the Newspaper Guild-CWA, and the People for the American Way Foundation.
The Justice Department occasionally seeks and judges occasionally order secret hearings, but the bulk of any case remains open. Judges keep some civil settlements confidential if both sides agree. But the appeals indicate court secrecy has been taken to new levels.
"One of the purposes of having an open court system is a check on the government in two ways. One is mistreatment of defendants. The other is excessive coziness with defendants," said First Amendment expert Floyd Abrams. "There's almost a Stalinist quality to this."
"When you get to the point where you have people convicted and sentenced and are sitting in a federal prison for multiple years and there is no record of how they got there, it's obvious to me things have gone way too far," said Lucy Dalglish, executive director of the Reporters Committee for Freedom of the Press.
No one outside the justice system knows how widespread the practice of so-called secret dockets is, and insiders aren't saying.
"We have secret arrests and we have secret trials and we have secret prisons and then we of course have secret police," said lawyer Frank Rubino. "It's getting closer and closer."

Greenpeace claims the Bush administration's irritation with the environmental group has mushroomed into a fundamental threat to dissent with a first-of-a-kind indictment of an advocacy group over a protest.
Federal prosecutors deny singling out Greenpeace and reject any First Amendment implications in their decision to enforce a law that hasn't been used since the 1800s. The nonprofit corporation is charged with illegally boarding a container ship carrying 70 tons of Amazon mahogany into the Port of Miami.
A judge plans to rule early this year on requests by Greenpeace, the Sierra Club, the American Civil Liberties Union and other groups to throw out the case and disclose Justice Department records to determine why charges were filed.
"It's an incredible abuse of power, and this is nothing short of political retribution," said Sierra Club spokesman Eric Antebi. "We think this sets a horrible precedent for political intimidation of public interest groups."
Greenpeace has been bothersome for President Bush since shortly after his inauguration when members put up a banner near his Texas ranch calling him the "toxic Texan."
Six Greenpeace activists were arrested on federal misdemeanor charges after two of them boarded the 965-foot APL Jade more than three miles off Miami Beach on April 12, 2002. The boarders carried a banner reading "President Bush, Stop Illegal Logging" that the ship's crew kept them from unfolding.
The group's indictment came 15 months later on misdemeanor charges of illegal boarding and conspiracy.
Defending the prosecution in court, Assistant U.S. Attorney Cameron Elliot insisted the group's vocal opposition to government policy "makes it no different from thousands of other political advocacy groups," he said.
And other groups are watching the case closely.
They say protesters accept their fate when they commit to nonviolent civil disobedience but note the federal government has never pursued the groups themselves on criminal charges. Not the Ku Klux Klan, not Operation Rescue, not the NAACP and not the Communist Party in any way upheld by federal courts.
They trace the history of American dissent from another ship protest, the Boston Tea Party, to anti-slavery, suffragist, civil rights and anti-war work in their challenge to prosecution.
"Greenpeace is an advocacy group. It is important that they be as free as possible to engage in their advocacy," said First Amendment expert Floyd Abrams. "The decision to indict Greenpeace seems to me to be constitutionally insensitive."
Todd Gaziano, director of the Center for Legal and Judicial Studies at the Heritage Foundation, a conservative think tank, said there should by no broad pronouncements against prosecuting organizations.
"Political advocacy ought not to insulate them if they really are encouraging criminal conduct," he said. "You have to look at the organization as a whole. That said, I'm going to have to be sympathetic with Greenpeace to a certain degree."
Greenpeace claims its protest called attention to the crime of illegal big leaf mahogany logging in the Brazilian Amazon and the Bush administration's failure to enforce an import ban in an international environmental treaty.
"Instead of prosecuting the smugglers, the Justice Department decided to brand Greenpeace a criminal operation," Greenpeace's attorney wrote in court papers.
In contrast, Brazilian government teams used a Greenpeace ship as their base for raiding illegal logging operations and seizing $7 million worth of felled mahogany after suspending logging in October 2001.
Greenpeace contends roads built by mahogany loggers are the root cause of Amazon deforestation. A FBI report said the Jade activists wore shorts emblazoned with the words "Greenpeace illegal forest crime unit."
The law used to prosecute Greenpeace poses questions all its own. It was written to keep boarding houses from pitching bunks, harlots and strong drink to inbound sailors "about to" dock.
When the prosecutor mentioned "sailor mongering" during arguments, a veteran court reporter making a transcript of the hearing interrupted to ask, "What kind of mongering?"
Greenpeace maintains a ship moving at 10 mph three miles at sea isn't covered by the law's "about to" requirement. The prosecutor retorted that an 1890 conviction was based on a boarding at the mouth of Oregon's Columbia River 50 miles from its dock in Portland. In the only other conviction on record, a New York judge who examined the law the year it was enacted called its language "inartistic and obscure."
One of the reasons Greenpeace is fighting so hard is the potential punishment: a $20,000 fine and five years probation. The group, which accepts no money from public agencies or corporations, would be pinched by the fine but believes the same government prosecuting it would yank its tax-exempt status if it won a conviction. Based on sentencing conditions, probation also could open Greenpeace finances, operations, support and membership to government inspection.
"For an advocacy organization dedicated to passionate dissent, that could be a crippling inhibition," attorney Richard Grosso wrote in friend-of-the-court papers for the Natural Resources Defense Council.
A report published by the Army War College calls the Bush administration's war on terrorism unfocused and says the invasion of Iraq was "a strategic error." The essay concludes with several recommendations. Some are fairly noncontroversial, such as increasing the size of the Army and Marines Corps, a position that appears to be gathering support in Congress. But he also says the United States should scale back its ambitions in Iraq, and be prepared to settle for a "friendly autocracy" there rather than a genuine democracy.

Northwest Airlines provided information on millions of passengers for a secret U.S. government air security project soon after the Sept. 11th terrorist attacks, raising fresh concerns among some privacy advocates about the airlines' use of confidential consumer data.
The nation's fourth-largest carrier publicly asserted in September that it "did not provide that type of information to anyone." But Northwest acknowledged it had already turned over three months of reservation data to the National Aeronautics and Space Administration's Ames Research Center by that point.
Northwest is the second carrier to have been identified as secretly passing travelers' records to the government. The airline industry has publicly said it would not cooperate in development of a new government computer passenger screening program because of concerns the project would infringe on customer privacy. But the participation of two airlines in separate programs underscores the industry's clandestine role in government security initiatives.
In September 2003, JetBlue admitted that it turned over passenger records to a defense contractor and apologized to its customers for doing so. Northwest said in a statement Jan. 16 (2004) that it participated in the NASA program after the 2001 terrorist attacks. The carrier declined to say how many passengers' records were shared with NASA from the period offered October to December 2001. More than 10.9 million passengers traveled on Northwest flights during that time, according to the Department of Transportation.

records typically include passenger credit card numbers,
addresses and telephone numbers.
NASA said it used the information to investigate whether "data mining" of the records could improve threat assessments of passengers.
The company said it did not inform any passengers that it shared data with NASA. It also said it did not believe that the data sharing violated its privacy policy. "Our privacy policy commits Northwest not to sell passenger information to third parties for marketing purposes," the company said in its statement. "This situation was entirely different, as we were providing the data to a government agency to conduct scientific research related to aviation security and we were confident that the privacy of passenger information would be maintained."
The disclosure of Northwest's participation with NASA comes just four months after JetBlue's admission of involvement in a secret security project conducted by the Pentagon. The airline conceded that it violated its own privacy policy when it turned over records of 1.1 million passengers and the carrier is now being sued by passengers in class action lawsuits.
The Northwest and NASA documents were released in response to a Freedom of Information Act request filed by the Electronic Privacy Information Center, a non-profit organization that advocates privacy rights and open government. The organization, which provided the documents to the Washington Post, said it plans to take legal action this week in an effort to force the government to disclose more information about NASA's secret security project and to investigate the airline's actions.
"We strongly believe aviation security programs should be developed publicly," said David L. Sobel, general counsel for the Electronic Privacy group. "While the airline in this case might have thought the action appropriate, the public at large sees it as a serious violation of personal privacy."
Northwest's data sharing might also have implications in Europe, where European Union officials have balked at providing European passenger data to the TSA as part of the agency's computer passenger screening program, known as CAPPS II. The European Union has said that turning over passenger records to TSA for the CAPPS II program would violate EU privacy laws.
NASA officials did not seem concerned about potential privacy violations until last fall, when news about JetBlue's cooperation with the Pentagon surfaced.
An article in the following day's St. Paul Pioneer Press reported, "Northwest Airlines will not share customer information, as JetBlue Airways has, Northwest CEO Richard Anderson said in brief remarks after addressing the St. Paul Rotary. "The Electronic Privacy Information Center said it originally filed a Freedom of Information Act request in 2002 with the Transportation Security Administration as part of an effort to obtain details of development of CAPPS II. Surprisingly, TSA responded to the request by providing NASA documents that indicated NASA was involved with the "data mining" system with Northwest Airlines. The CAPPS II system, scheduled to debut this summer, seeks to identify all U.S. passengers using commercial databases and then rate the security risk of each passenger as red, yellow or green.
The Electronic Privacy group and other privacy activists have argued for years that CAPPS II is being developed under strict secrecy and they believe that plans disclosed so far appear to violate personal privacy.

one more reason to be wary about CAPPS II. What this makes plain
is that we cannot believe the assurances we have received that

Police in Florida are creating a counterterrorism database designed to give law enforcement agencies around the country a powerful new tool to analyze billions of records about both criminals and ordinary Americans. Organizers said the system, dubbed Matrix, enables investigators to find patterns and links among people and events faster than ever before, combining police records with commercially available collections of personal information about most American adults. The state-level program, aided by federal funding, is poised to expand across the nation at a time when Congress has been sharply critical of similar data-driven systems on the federal level, such as a Pentagon plan for global surveillance and an air-passenger-screening system.
The Florida system is another example of the ongoing post-Sept. 11 debate about the proper balance between national security and individual privacy. The Department of Homeland Security announced plans to launch a pilot law-enforcement data sharing network that will include Virginia, Maryland, Pennsylvania and New York. Some civil liberties groups fear Matrix will dramatically lower the threshold for government snooping because other systems don't allow searches of criminal and commercial records with such ease or speed. "It's going to make fishing expeditions so much more convenient," said Ari Schwartz, associate director of the Center for Democracy and Technology, a nonprofit that monitors privacy issues. "There's going to be a push to use it for many different kinds of purposes." A senior official overseeing the project acknowledged it could be intrusive and pledged to use it with restraint. "It's scary. It could be abused. I mean, I can call up everything about you, your pictures and pictures of your neighbors," said Phil Ramer, special agent in charge of statewide intelligence. "Our biggest problem now is everybody who hears about it wants it."
The Justice Department has provided $4 million to expand the Matrix program nationally and will provide the computer network for information sharing among the states, according to documents and interviews. The Department of Homeland Security has pledged $8 million, state officials said. At least 135 police agencies in the state have signed up for the Florida Department of Law Enforcement database service, which began operation more than a year ago. At least a dozen states -- including Pennsylvania, New York and Michigan -- said they want to add their records.
Seisint Inc., a Boca Raton, Fla. company, developed the Matrix system soon after the 2001 attacks. The Florida legislature just allocated $1.6 million to begin paying Seisint for its work.

Matrix was initially intended to track terrorists, as was the Terrorism Information Awareness project of the Pentagon. As more states pool their criminal and government files with Florida's, Matrix databases are expanding in size and power. Organizers hope to coax more states to join, touting its usefulness in everyday policing. It gives investigators access to personal data, like boat registrations and property deeds, without the government possibly violating the 1974 Privacy Act by owning the files. But California and Texas dropped out, citing, among other things, worries over housing sensitive files at Seisint. And a competing data vendor, ChoicePoint, decided not to bid on the project, saying it lacked adequate privacy safeguards.
Aspects of the project appear designed to steer around federal laws that bar the U.S. government from collecting routine data on Americans. For instance, the project is billed as a tool for state and local police, but organizers are considering giving access to the Central Intelligence Agency, said Phil Ramer, special agent in charge of the Florida Department of Law Enforcement's intelligence office.
Initially 14 states signed up for Matrix, but the Matrix project coordinator at the institute for intergovernmental research, confirmed that number dropped to eight. Louisiana and Alabama were the most recent to pull out. Georgia's attorney general was still debating whether Georgia's own privacy laws allow it to share its drivers license data with matrix.
Florida officials have acknowledged that users of Matrix, which stands for Multistate Anti-Terrorism Information Exchange, can "monitor innocent citizens."
A Florida Department of Law Enforcement memo shows potential lapses in oversight. The memo says background checks on Seisint's Matrix workers took place more than a year into the program, and a privacy-policy governing the databases use has yet to be finalized.
The Florida Department of Law Enforcement refused to show reporters the Matrix system. Law enforcement officers are also using the Datamaxx commercial system as part of a pilot project. Within seconds, Datamaxx hand held computers can find your social security number, address and former address. American Civil-Liberties Union attorney Larry Spalding questions why the FDLE will not show the press the Matrix system. "If they're just pulling public records they shouldn't be concerned. Since they're hiding it, it makes us wonder what else they're using the Matrix for."
A seven-state crime database launched with $12 million in federal funds is a more powerful threat to privacy than its organizers acknowledge, the American Civil Liberties Union alleged after obtaining documents relating to the program.
The law enforcement officials and private database company behind the Multistate Anti-Terrorism Information Exchange, or Matrix, contend it is merely an investigative tool that helps police quickly gather already-available information on suspects.
But the ACLU and other privacy advocates allege that the program too closely resembles a scrapped Pentagon program that aimed to mine a vast pool of data to spot patterns useful in terrorism investigations. Congress cut off funding last year for the so-called Total Information Awareness program after a privacy outcry.
A Freedom of Information Act request filed with Pennsylvania yielded several documents that the ACLU says clearly show the Matrix's data-mining abilities. Among them were minutes of a 2002-planning meeting that said the FBI, the Secret Service, the Immigration and Naturalization Service and the Drug Enforcement Agency helped craft data-mining software for Matrix.
That represents more federal involvement in the program than previously known, though the Departments of Justice and Homeland Security invested $12 million to get the system running.
The Pennsylvania documents include security and privacy policies that say Matrix is usable only in active criminal or intelligence investigations. Barry Steinhardt, director of the ACLU's technology and liberty program, calls those guidelines too broad and susceptible to abuse.
Clay Jester is the Matrix coordinator for the Institute for Intergovernmental Research, a nonprofit group helping to expand the project from its original implementation in Florida.
Matrix lets states share criminal, prison and vehicle information with each other and cross-reference it with up to 20 billion records in databases held by Seisint Inc. For now the project involves Connecticut, Florida, Michigan, New York, Ohio, Pennsylvania, and Utah, though not all those states are using the system yet. In all, about 450 law enforcement agents can access Matrix, Jester said.
Several other states explored the program before dropping out because of concerns about privacy or the long-term cost, including Alabama, California, Georgia, Louisiana, Kentucky, Oregon, South Carolina and Texas.

The real estate, insurance and jewelry industries are being
targeted by federal regulators in the next round of rule-making
in the financial pursuit of criminals and terrorists.
"This is new for folks, and we recognize that," William
Fox, new director of the Treasury Department's Financial Crimes
Enforcement Network, said at the ninth annual International Money
Laundering Conference.
The agency issued notices last year to prepare the industries for
regulations to come, and the department is telling everyone to
expect something this year. Bankers and broker-dealers have been
regulated for years.
Under the threat of financial penalties, banks have grown
accustomed to filing millions of reports a year on large currency
transactions and anything that looks
suspicious. But the next round of rules are
already met with wariness and outrage by the newly affected
industries.
National associations for real estate agents, mortgage brokers
and title companies voiced their objections after the Treasury
Department announced its plans to write rules for the industry
last April 2003.
William Langford, senior adviser to Treasury's general counsel,
told the gathering, "Financial regulations for insurance
companies need to come out pretty quickly."
Wholesale and retail dealers in precious metals, stones and
jewels also have rules on the horizon. Regulators want to target
crime profits that, very simply, can be sewn into the lining of a
jacket.
The Treasury Department's Financial Crimes Enforcement Network
also has the power to expand regulations to pawnbrokers, travel
agencies and car and plane dealers.

Enforcement Network (FinCEN), said he worked for two years on
terrorist financing after the 2001 terrorist attacks and before
being named to head what is called FinCEN in December 2003.
Law enforcement uses the financial reports collected by Treasury
Department's Financial Crimes Enforcement Network to pursue
crimes and terrorism, and the scope of the agency's work expanded
under the Patriot Act.
Fox said he is committed to creating a searchable database
available to law enforcement and expanding the FinCEN's
analytical powers to identify suspicious areas.

President Bush signed legislation making it easier for FBI agents investigating terrorism to demand financial records from casinos, car dealerships and other businesses.
The changes were included in a bill authorizing 2004 intelligence programs. Most details of the bill are secret, including the total costs of the programs, which are estimated to be about $40 billion. That would be slightly more than Bush had requested.

The bill expands the number of businesses from which the FBI and other U.S. authorities conducting intelligence work can demand financial records without seeking court approval.
Under current law, "national security letters" can be issued to traditional financial institutions, such as banks and credit unions, to require them to turn over information. The bill expands the definition of financial institution to include other businesses that deal with large amounts of cash.
Supporters of the change say it will help authorities identify money laundering and other activities that fund terrorism. But some lawmakers and civil liberties advocates say the change does not provide enough safeguards to ensure that authorities will not violate the privacy of innocent people.
In other provisions, the bill:
_Creates a new intelligence office in the Treasury Department to improve coordination with intelligence agencies on fighting terrorist financing.
_Creates pilot programs to examine whether analysts from one agency should have access to raw data from another and to improve information sharing with state and local governments.
_Authorizes agencies to continue research on computerized terrorism surveillance projects formerly operated by the Defense Department. Those projects were widely criticized on civil liberties grounds, prompting Congress to remove them from the Pentagon.

The FBI, unhindered by the restrictions of the past, will conduct many more searches and wiretaps that are subject to oversight by a secret intelligence court rather than regular criminal courts, officials said. Civil liberties groups and defense lawyers predict that more innocent people will be the targets of clandestine surveillance.
The new strategy -- launched in early summer and finalized in a classified directive issued to FBI field offices in October -- goes further than has been publicly discussed by FBI officials in the past and marks the final step in tearing down the legal wall that had separated criminal and intelligence investigations since the spying scandals of the 1970s, authorities said.
Senior FBI officials said the changes have already helped the bureau disrupt plans for at least four terrorist attacks overseas and uncover a terrorist sleeper cell in the United States, though they declined to provide details on those cases. The approach also has resulted in a notable surge in the number of counterterrorism investigations, a statistic that is classified but currently stands at more than 1,000 cases, officials said.
To civil libertarians and many defense lawyers, the changes pose a threat to the privacy and due-process rights of civilians because they essentially eliminate, rather than merely blur, the traditional boundaries separating criminal and intelligence investigations. As a result, these critics say, FBI agents and federal prosecutors will conduct many more searches and seizures in secret, as allowed under intelligence laws, rather than being constrained by the rules of traditional criminal warrants.
"By eliminating any distinction between criminal and intelligence classifications, it reduces the respect for the ordinary constitutional protections that people have," said Joshua L. Dratel, a New York lawyer who has filed legal briefs opposing government anti-terrorism policies. "It will result in a funneling of all cases into an intelligence mode. It's an end run around the Fourth Amendment," which protects citizens from unreasonable searches, he said.
The overhaul of the FBI's counterterrorism policies began earlier this year with a classified document called the Model Counterterrorism Investigations Strategy (MCIS), officials said. The strategy stems from a November 2002 decision by an intelligence appeals court, which ruled that the anti-terrorism USA Patriot Act permits intelligence investigators and criminal prosecutors to more easily share information about terrorism cases.
The MCIS and other rules effectively put that finding into practice by reworking the way terrorism cases are handled by the FBI, and by requiring that both criminal and intelligence investigators physically work as part of the same squads on terrorism investigations, officials said. FBI officials declined to release copies of the MCIS or a related Oct. 1 directive, citing national security restrictions, but agreed to describe the outlines of the process.
Under previous FBI protocols, terrorism probes could be opened along two separate tracks, one for the purposes of developing a criminal case and one for intelligence gathering. Each was labeled with separate classification numbers, which govern the way cases are tracked and budgeted within the FBI. Sharing between the two categories was sharply limited, overseen by legal mediators from the FBI and Justice Department, and subject to scrutiny by criminal courts and the secret Foreign Intelligence Surveillance Court.
Under the new guidelines, all counterterrorism cases are opened under the same classification number, 315, and are handled from the outset like an intelligence or espionage investigation, officials said. The structure allows investigators to more easily use secret warrants and other methods that are overseen by the surveillance court and not available in traditional criminal probes, sources said.
All terrorism cases will also be formally run by the counterterrorism division at FBI headquarters in Washington, rather than by individual field offices, officials said.
Pistole said that focusing on intelligence gathering will improve the ability of the FBI to prevent, rather than just investigate, terrorist attacks. He and other FBI officials also said the new system will result in less emphasis on bringing criminal charges against suspects in favor of longer surveillance operations. When charges are eventually brought, however, prosecutors will be able to use information gathered through intelligence methods.

are necessary to transform the FBI from a reactive law
enforcement agency into one capable of detecting and thwarting
terrorist attacks before they occur. According to a study
released this week by Syracuse University's Transactional Records
Access Clearinghouse, Justice and the FBI have sharply increased
the number of terrorism cases they are pursuing since the 2001
attacks, although most of the 6,400 people referred to
prosecutors were never charged with a crime related to terrorism.

Several civil liberties advocates and defense lawyers said the new FBI rules appear to encourage agents to ignore constitutional concerns and to push the boundaries of what is allowed by recent court rulings. Ann Beeson, a staff attorney at the American Civil Liberties Union, said the system will encourage prosecutors to rely too heavily on evidence gathered by secret intelligence methods.
"They're going to use all their foreign intelligence tools, and then they're going to prosecute people using those tools," Beeson said. "They're putting this whole class of criminal cases outside the protection of the Fourth Amendment." Michael A. Vatis, a former Justice Department and FBI official, said the changes are necessary but acknowledged the risk that investigators could overreach. "The principal danger is what the old rules were designed to avoid: to make sure that the FBI wasn't using intelligence authorities when they were really just looking to bust bad guys," he said. "There does need to be good oversight to make sure these new rules are not abused."

A federal commission is
calling on President Bush to create an advisory board to assess
the impact on Americans' civil liberties of such anti-terrorism
moves as the Patriot Act. A panel should be convened to study
such issues, and should include both Republicans and Democrats,
as well as academics and officials from the private sector, it
said. According to advance reports, the commission was expressing
concern that the administration has failed to develop a
comprehensive, forward-looking strategy to combat terrorism more

The Bush administration intensified its defense of the anti-terrorism Patriot Act, threatening to veto legislation in Congress that would scale back key provisions. The threat came a week after Bush, in his State of the Union address, urged Congress to reauthorize the Patriot Act before it expires in 2005.
Anthony Romero, executive director of the American Civil Liberties Union, said the veto threat shows that the Bush administration is on the defensive. The ACLU has filed a lawsuit in federal court challenging a key portion of the law, and 241 state and local governments also have gone on record opposing it.
"The attorney general's attack on the SAFE Act shows how out of step the Bush administration is with growing national concern over the Patriot Act," Romero said.
The SAFE Act, which has not yet had a hearing in either the House or Senate, was introduced last fall of 2003 by Sens. Larry Craig, R-Idaho; Dick Durbin, D-Ill.; and other lawmakers of both parties who say the Patriot Act has gone too far.
"Attorney General Ashcroft's response today is an unfortunate overreaction to a reasoned and measured effort to mend the Patriot Act," Durbin said Jan. 29, 2004. "I believe it is possible to combat terrorism and preserve our individual freedoms at the same time. "This legislation restores the necessary checks and balances to the system."
The bill would modify so-called "sneak and peek" search warrants that allow for indefinitely delayed notification when a person's property is searched, mandating such notice within a week's time. In addition, warrants for roving wiretaps used to monitor a suspect's multiple cell phones would have to make sure the target was positively identified and was present at the site being monitored before information could be collected.
The legislation also would
reinstate standards in place prior to passage of the Patriot Act
regarding library and other business records by forcing the FBI
to show it had reason to believe the person involved was a
suspected terrorist or spy. The measure would impose expiration
dates on nationwide search warrants and other Patriot Act terms,
providing for congressional review.

A federal judge in Los
Angeles on Jan. 23, 2004, has struck down as too vague part of
the Patriot Act that bars providing "expert advice and
assistance" to foreign terrorist groups -- marking the first
time a court has declared part of the law unconstitutional.
The written ruling by U.S. District Judge Audrey B. Collins came
in a 2003 challenge to the Patriot Act by five organizations and
two individuals who sought to support Kurds in Turkey and Tamils
in Sri Lanka.
"The ruling is significant in that it strikes the statute
down as being in violation of the Fifth and First Amendments,"
David Cole, a Georgetown University law professor who argued the
case for the Humanitarian Law Project.
"It underscores what so many have said all along about the
Patriot Act -- that Congress, in acting so hastily after 9-11,
swept far too broadly and didn't pay significant attention to
constitutional rights and liberties," he said.
A U.S. Department of Justice spokesman said in a written
statement that attorneys there were reviewing the decision.
According to a European Union poll of more than 7,500 Europeans, more than half (some 52 per cent) placed the founding members of the so-called axis close to the top of their list of threats to the planet. Precisely the same number of Europeans said America was a threat to world peace, ranking the Bush administration alongside Kim Jong Il’s tyranny in Pyongyang and the hard-line theocracy of Tehran.
In fact, the United States was only beaten into joint second place by a country that has never sponsored terrorist attacks on European soil. A staggering 59 per cent of this huge poll—released this week—placed Israel at the top of the list of world threats. That was 22 points ahead of Syria, 23 points ahead of Libya and Saudi Arabia, and 43 points ahead of Somalia.
The European poll shows this dispute has gone far beyond name-calling. What started out as a little overheated rhetoric has grown into a full-blown crisis that threatens U.S. policy across the world. And we’re not just talking about Iraq.
In Latin America, the warning signs about U.S. policy are lit up across the continent. In Bolivia, the pro-American president Gonzalo Sanchez de Lozada was toppled after a month of street protests and violent clashes. One of his biggest political weaknesses: his support for U.S. policy on energy and drugs. In Colombia, the ardently pro-American president Alvaro Uribe took a beating in the polls, leading to the election of a former communist as mayor of the capital Bogota. And in Brazil, President Luis Inacio Lula da Silva effectively torpedoed U.S. trade policy by forcing the collapse of the world trade talks in Cancun two months ago. As in Europe, political leaders in Latin America are finding it costly to support Washington while the critics of the Bush administration are prospering.
As in America’s backyard, anti-Bush feeling has gone far beyond a knee-jerk reaction to U.S. policy. It now feeds into domestic politics and has grown into one of the biggest obstacles to what Washington wants to do next.
The Bush administration runs the risk of a total collapse in political support in Europe.
